The Wildfang 2024 Review Sweepstakes Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.
I. SWEEPSTAKES PERIOD: "Wildfang 2024 Review Sweepstakes” Sweepstakes (the “Sweepstakes”) begins on or about 12:00:01 a.m. Pacific Time (“PT”) on October 15th, 2024 and ends at 11:59:59 p.m. PT on January 30th, 2025. The Sweepstakes consists of separate entry periods as set forth immediately below (“Entry Period(s)”). Each Entry Period begins at 12:00 am PDT on the first date of each Entry Period and ends at 11:59 pm PDT on the last date of each Entry Period. All online entries must be received by 11:59:59 PM PST on the last day of the applicable Entry Period to be considered. The Sweepstakes is sponsored by Wildfang Co., PO BOX 16037, Portland, OR 97219 (the “Sponsor”, “Prize Supplier”, and “Sweepstakes Administrator”). The official clock for purposes of the Sweepstakes is the computer of the Sponsor.
Entry Period 1: Begins 10/15/2024, Ends 10/31/2024
Entry Period 2: Begins 11/1/2024, Ends 11/30/2024
Entry Period 3: Begins 12/1/2024, Ends 12/31/2024
Entry Period 4: Begins 1/1/2025, Ends 1/31/2025
II. ELIGIBILITY: The Sweepstakes is open to all legal residents of forty eight (48) contiguous states of the United States (void in Rhode Island), and the District of Columbia, that are at least twenty-one (21) years old as of the date of entry. Officers, directors, representatives and employees of the Sponsor, and any of their respective parent companies, affiliated companies, subsidiaries, dealers, franchisees, licensees, distributors, suppliers, subsidiaries, participating retailers, advertising / promotion / judging agencies, Co-Prize Suppliers, persons engaged in the development, production or distribution of materials for this Sweepstakes (collectively, the “Released Parties”) and the immediate family members (defined as spouse, parents, grandparents, children, grandchildren, siblings, - whether biological, adopted, step or in-law) of such individuals, or persons living in the same household as such individuals (whether related or not), are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local, provincial and municipal laws and regulations. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor and Sweepstakes Administrator's decisions, which are final and binding in all matters related to the Sweepstakes. If it is found that a person who does not meet the eligibility criteria set forth in these rules has submitted an entry, that entry will be deemed ineligible and any prize awarded shall be revoked. Winning a prize is contingent upon fulfilling all requirements set forth herein. Void in Canada, Puerto Rico, the U.S. Virgin Islands, Guam, U.S. Military installations in foreign countries, and where prohibited, taxed, or restricted by law, regulation or ordinance.
III. HOW TO ENTER THE SWEEPSTAKES:
An individual will be deemed a participant ("Participant") in the Sweepstakes if they are eligible and enter the Sweepstakes via the Sponsor’s microsite. Participants can visitwww.wildfang.com (“Website”) during one or more Entry Periods described above, and follow the instructions to submit a review of any Wildfang product that you have purchased or own. There is no limit to the number of products you may review, but there is a limit of one (1) review per product. Online entries must be received within an Entry Period to be considered eligible for a prize for that specific Entry Period, and no entries within a specific Entry Period will roll over into the next Entry Period. You will have an opportunity to enter the Sweepstakes once for each product review that you submit pursuant to these Rules. All product reviews must be in English and are subject to the Sponsor’s Terms of Use. You will be required to provide your name and certain other information as requested. For any review you submit in connection with the Sweepstakes, you agree to comply with all applicable federal or state laws. Reviews should be truthful and whether review is positive or negative will not affect your odds of winning.
By registering and submitting an entry, the Participant certifies they have read and agree with these Official Rules. All required information must be completed to enter and to be eligible to win. Incomplete entries will be disqualified. Proof of entering information at the Website is not considered proof of delivery to or receipt by Sponsor of an entry. Internet entries must be made by the entrant only at the Website. Entries made by any other individual or any entity, and/or originating at any other web site, including, but not limited to, commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes. The use of automated entry devices is prohibited and no mechanically reproduced entries are allowed; all such entries are void. Released Parties are not responsible for: lost, late, incomplete, illegible, incorrect, delayed, garbled, undelivered, or misdirected entries. Sponsor reserves the right, in its sole discretion, to void any and all entries of an entrant that submits more than the stated maximum limit of entries by using multiple/different addresses, identities, or any other methods, or who Sponsor believes has attempted to tamper with, influence or impair the administration, security, fairness, or proper play of this Sweepstakes. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.
IV: USE OF PERSONAL INFORMATION / OPT-IN: By participating in the Sweepstakes, each Participant consents for the Sponsor to obtain, use, and transfer your name, email address and other information (“Personal Information”) for the purpose of administering this Sweepstakes. By opting in to receive future marketing emails, such Personal Information will be kept by both Sponsor for marketing purposes in accordance with their respective privacy policies. The information that each Participant provides in connection with the entry process will be used by Sponsor and Media Partner only, and will not be sold or provided to another company. Each Participant will remain eligible for this Sweepstakes whether or not the Participant opts in to receive future promotional e-mails from Sponsor and/or Media Partner.
VII. PRIZES:There will be four (4) Prize winners. Each Prize winner will one (1) $500 Wildfang gift card. The approximate retail value of the Prize is $500.
VIII. PRIZE TERMS AND CONDITIONS:The Prize winner is required to comply with any and all applicable federal, state, local, provincial and municipal laws, rules and regulations. The Prize winner will be required, where permitted by law, to sign an Affidavit of Eligibility and Liability/Publicity Release (collectively, the “Prize Acceptance Release”), and return it withinfive (5) days of written notification or the prize may be forfeited and an alternate potential winner selected, time-permitting. Additionally some information may be required from the Prize winner for tax reporting purposes, in order to receive the Prize. If a prize or prize notification is returned as unclaimed or undeliverable to a potential winner, if potential winner cannot be reached within three (3) calendar days from the first notification attempt, if potential winner fails to return requisite documents within the specified time period, and/or if a potential winner is not in compliance with these Official Rules, then such person shall be disqualified and an alternate winner will be selected for the prize at issue, time-permitting. Sponsor will use reasonable efforts to award the prize to an alternate winner but in the event one cannot be reasonably determined, such prize will not be awarded. To claim the Prize, you will be required to provide your correct full name, mailing address, date of birth, telephone number, e-mail address, as well as information for tax reporting purposes. The Prize Acceptance Release is subject to verification by Sponsor and the prize winner may be subject to verification before any prize will be awarded.
The Sponsor and Released Parties have not made any warranty, representation or guarantee, expressed or implied, in fact or in law, with respect to any prize awarded and specifically disclaim all such warranties, including, without limitation, any warranty of merchantability or fitness for a particular purpose. Prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND either expressed or implied. A prize may not be sold, traded, or commissioned, and is not exchangeable, transferable, or redeemable for cash. Prize details and availability are subject to change. There are no substitutions unless specified by the Sponsor. The Sponsor reserves the right at its sole discretion to substitute any prize (or prize component) with another prize (or prize component) of equal or greater value. Prizes may be fulfilled by a third party. The Sponsor and Released Parties are not in any way responsible or liable for damages resulting from shipping and handling, loss, use or misuse of any prize awarded in this Sweepstakes.
The prize winner will be solely responsible for all federal, state, municipal, and/or local taxes, and for any other fees or costs associated with the prize they receive. The stated “ARV” of the prize is based on available information provided to Sponsor, and any difference in ARV at the time of awarding will not be awarded, and the value of the prize awarded to a winner may be reported for tax purposes as required by law. The Prize winner will be required to provide the Prize Acceptance Release (where lawful), and proof of Identification document, and such other documents as may be determined by Sponsor.
The winner’s acceptance of a prize constitutes permission (except where prohibited) for the Sponsor to use the winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state) for any and all public relations, advertising and/or promotional purposes as determined by Sponsor, in all forms of media and by all manners (now and hereafter known), in perpetuity, without notice, consent, review or approval or further compensation.
Except where prohibited, as a condition of participating in this Sweepstakes, the parties agree that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, or the determination of winners shall be resolved individually, without resort to any form of class action exclusively by arbitration pursuant to the commercial arbitration rules of the American Arbitration Association, then effective. Further, in any such dispute, under no circumstances will Participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than Participant's actual out-of-pocket expenses (e.g., costs associated with entering this Sweepstakes), and Participant further waives all rights to have damages multiplied or increased. The arbitration shall be conducted in the State of Oregon, in the City of Portland, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. The arbitrator will apply the substantive laws of the State of Oregon, will issue a written decision and will have the power to award any legal remedies except as limited by these Official Rules. The parties will split the arbitrator’s fee; provided, however, if applicable law requires Sponsor to pay the arbitrator’s fee in order for the arbitration provision to be enforceable, Sponsor shall have the discretion to elect to pay such fees and proceed to arbitration. Participant irrevocably waives any right to bring or join in any class action regarding the Sweepstakes. Judgment upon the arbitration award may be entered in any court having jurisdiction thereof. This arbitration provision shall be deemed to be self-executing, and in the event that any party fails to appear to any properly noticed arbitration proceeding, an award may be entered against such party notwithstanding said failure to appear.
BY ENTERING THE SWEEPSTAKES, PARTICIPANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED ONE HUNDRED DOLLARS ($100.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (2) UNDER NO CIRCUMSTANCES WILL ANY PARTICIPANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED ONE HUNDRED DOLLARS ($100.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (3) PARTICIPANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND PARTICIPANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

XIII. WINNERS LIST REQUEST:To request confirmation of the name and city/state of residence for the Prize winner, please send a self-addressed, stamped business size envelope, by February 3rd, 2025, to: Wildfang 2023 Sign-Up Sweepstakes Official Rules, PO BOX 16037, Portland, OR 97219. Requests received after February 3rd, 2025 will not be acknowledged or returned.

MISCELLANEOUS: The names of individuals, groups, companies, products and services mentioned herein, and any corresponding likenesses, logos and images thereof reproduced herein, have been used for identification purposes only and may be the copyrighted properties and trademarks of their respective owners. The mention of any individual, group or company, or the inclusion of a product or service as a prize, does not imply any association with or endorsement by such individual, group or company or the manufacturer or distributor of such product or service and, except as otherwise indicated, no association or endorsement is intended or should be inferred. The invalidity or unenforceability of any provision of these Official Rules or the Prize Acceptance Release will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules or the Prize Acceptance Release is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. For Participant, to the extent there is a conflict between Official Rules appearing any other location and any terms of use or other agreements posted on the Sponsor's Website, these are the Official Rules to be abided by.
